1. Relation user- Ecreation's company
1.1. User makes use of products, software, services and websites, which are property of Ecreation (called in this document "Services", excluding services directed to User by Ecreation's company on the basis of separate contract) on terms of the contract between User and Ecreation's company. By "Ecreation's company" we mean Ecreation's company B.V. Havenstraat 13b 3441BH Woerden in the Netherlands. This document contains description of the contract and some of its conditions.
1.2. Contract between User and Ecreation's company includes also conditions of potential legislative Information, transferred in order to supplement General Conditions, further called "Additional Conditions".
1.3. In case of difference between the content of Additional Conditions and General Conditions, for the purpose of services, Additional Conditions will have decisive character.
1.4. General Conditions with Additional Conditions institutes binding contract from the legal point of view between User and Ecreation's company, which is the basis for using Services by User. For User it is important to get know their content. In further part of the document, contract will be called "Conditions".
1.5. If document do not decide differently, conditions of contract between User and Ecreation's company, are those written in this document. In the further part of this document they will be called "General Conditions".
2. Making services available by Ecreation's company
2.1. Ecreation's company introduces constant innovations to provide the User the best possible use of the services. User acknowledges that form and character of services, which are available, are liable to periodical changes without the need to inform User about changes and without his agreement to it.
2.2. Ecreation is a subject, which has dependent and affiliated subjects all over the world ("Dependent subjects"). In some cases, subjects can make servers accessible for User, in the name of Ecreation's company. User acknowledges that Dependent subjects have the right to make servers accessible for User and agrees to this situation.
3. Conditions' language
3.1. In case of difference between Dutch language version and its translation, conditions in Dutch language are decisive.
3.2. If Ecreation transferred translations to User, User acknowledges that translation has only supporting character and the relation: User- Ecreation are regulated by the Dutch version of the document.
4. Advertisements
4.1. Some of Services are financed by advertisements, so in Services advertisements and promotional offers can be visible. Advertisements can be connected with the content of information, saved in Servers, in case of questions, directed by an agency to Servers or within different information.
4.2. The way, procedure and the number of advertisements placed by Ecreation's company in Services may be changed without prior notice.
4.3. Instead of ensuring access and the right to use Services by User, User agrees to place advertisements in Services.
5. Exclusion of the guarantee
5.1. Services are available "just like they are", without guarantee, so that Ecreation, Dependent and Affiliated Subjects and also licensors do not grant a guarantee.
5.2. In the World of Alice, it cannot be used any different conditions, guarantees or decisions (as well as conditions, concerning satisfactory quality, usability for defined purpose and conformity with description), unless it was explicitly defined in Conditions.
5.3. Especially, Ecreation, Dependent Subjects and licensors of Ecreation do not declare and guarantee that:
a. Information acquired by User as a result of using Services are precise and reliable and working defects of software transformed to User will be removed.
b. Using of Services by User will satisfy his requirements.
c. User will can use Services continuously, promptly, safely and free from mistakes.
5.4. Decisions of this conditions will have no influence on User rights as a consumer, that User cannot change and resign from them under an agreement.
6. Limitation of liability
6.1. Decision of this conditions are not the base of exclusion and limitation of the Ecreation’s liability for losses, for which the responsibility cannot be excluded and limited in conformity with the current legal regulations.
6.2. Limitation of liability of the Ecreation towards User, which has been described above
in 6.1., will have application regardless of situation if Ecreation was prejudiced about the possibility of losses and if the company expects it.
6.3. With the reservation that decision of the general condition Ecreation, Dependent Subjects will not be financially liable for indirect losses, which User can incur. Those losses include the loss of profit (directly or indirectly), loss of renown and reputation or loss of User's personal data.
7. Using of Services by User
7.1. User agrees, unless he gets from Ecreation agreement under a special procedure of separate contract, that he will not copy, sale and resell Services.
7.2. User acknowledges that he takes the responsibility of (and that Ecreation do not take the responsibility to User and any third person) infringement of User's obligations, arising from Conditions and for results (losses and damages suffered by Ecreation) of this infringement.
8. Different contents
8.1. User acknowledges and agrees that Ecreation do not take the responsibility of websites' availability or third people's resources and do not firm advertisements, products and different materials, that are available by the agency of websites and resources.
8.2. In Services can be placed links to different websites, contents and resources. Ecreation cannot have the influence on websites and resources descended from the companies and people different than Ecreation.
8.3. User acknowledges and agrees that Ecreation does not take the responsibility of losses and damages, that User can incur as a result of availability external websites and resources, or different actions made by User on the basis of conviction that advertisement, products and materials, which are on the websites, are complete and accurate, or that they exist.
9. Changes of conditions
9.1. Ecreation can periodically introduce changes to General Conditions and Additional Conditions. After introductions, Ecreation will make available the new version of General Conditions, which will be available on website: http://www.worldofalice.com/, and the new version of Additional Conditions will be available to User on services, which it concerns.
9.2. User acknowledges that using of servers by User after the change's date of the General Conditions and Additional Conditions is tantamount to User's agreement to General Conditions and Additional Conditions in new version.
10. General legal conditions
10.1. Conditions and relations between User and Ecreation, resulting from Conditions, is liable to the Dutch law. User and Ecreation agree to submission of exclusive jurisdiction the Dutch court of justice in order to termination the whole legal laws, resulting from Conditions. Regardless of the above, User acknowledges that Ecreation will have the right to sue for the security of any jurisdiction. (or equivalent kind of security under a special procedure).
10.2. User acknowledges that Ecreation's non-performance by law or legal measure, stipulated by Conditions, (or available to Ecreation's company with legal regulation in force) is not unequivocal with formal abdication from law and legal measures by Ecreation, and they will be still available to Ecreation.
10.3. In case, when proper court of justice, considers subjective opinion that any of those Conditions is legal, decision will be deleted from Conditions and will have no influence on the others Conditions. The other Conditions will be still valid and enforceable.
11. Gathered information and ways of using it:
In Alice we offer gathering information through different channels. It does not require registration of personal information to use this possibility. To cover the complete working area of services we offer the following types of information.
- Links – The size of offered links allows registration of clicks to these connections. We will gather this information to raise the quality of our technology information recuperating and displaying of adjusted content and advertising purposes.
- Correspondence with users: - We can preserve correspondence, directed to Alice to answer questions react on requests and improvement of our services.
- Conversations with users: – All conversations with Alice, are anonymously stored and can be used to improve the program of Alice. Parts of conversations can be used for displaying in the shoutbox on the website.
Safety Information - For the protection of personal data, we use appropriate security measures against unauthorized access and modification, disclosure or destruction. Measures such as internal control of personal data collected, procedures for storage and processing, and security, including physical security measures to protect against unauthorized access to systems where we hold information.
Other websites - The privacy conditions wich this document contains regarding website and the services are property of Ecreation. The websites, which as a result of information retrieval or connections in our various services are not subordinated by us and we are not responsible for these sites, the different sites may use their own cookies files or other files on your computer to collect data or questions to your personal data.
Affiliated sites - regarding several websites, we can apply some of our services. The data, which are on the websites added to Ecreation can be made to the services alone. The data are processed in harmony with those rules. The affiliated sites may use different rules to protect privacy. We encourage you to review those rules to know.
The chatbot - If the user in the chatbot "Alice" explicitly agree to these conditions, the user subscribe to e-mail messages from 'World of Alice (from 2 to 4 times per month). This e-mail exists, but is not limited solely to news about World of Alice, but information, social campaigns, promotional games and / or links to offers from selected partners can also be added. Ecreation processed data on Dutch servers and also in several other countries. In some cases, we process personal data on a server, which is in another country than the user. We may process personal data to our own services. In some cases, we can use personal data, in agreement with third parties, such as our advertising partners process.
Compliance with the conditions, the compliance of activities of Alice - We systematically monitor those conditions. Amendment of conditions - The conditions of privacy can be changed. The changes in all conditions will be published on this website. We will contact you about possible changes in a visible way information. Future versions of the conditions contain the date of the coming into force.
